The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013
The PoSH Act, 2013, is a landmark legislation enacted to ensure protection against sexual harassment of women at the workplace and to uphold their right to equality, life, and livelihood with dignity. It provides a comprehensive redressal mechanism by mandating the constitution of an Internal Committee (IC) in every workplace with 10 or more employees to receive and address complaints of sexual harassment. For workplaces with fewer than 10 employees or where the complaint is against the employer, a Local Committee (LC) is to be constituted at the district level by the District Officer to ensure access to justice. The Act clearly defines what constitutes sexual harassment, lays down the procedures for complaint, inquiry, and appeal, and prescribes the duties of employers and authorities to prevent and respond to such misconduct. It is rooted in the principles of the Indian Constitution and aligned with global human rights commitments, including the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW), ratified by India in 1993.

UGC PoSH Regulations, 2015
University Grants Commission (Prevention, Prohibition and Redressal of Sexual Harassment of Women Employees and Students in Higher Educational Institutions) Regulations, 2015
These UGC Regulations, issued under the UGC Act, 1956, extend the protection of the PoSH Act to all higher educational institutions in India. Applicable to both employees and students, the regulations require universities and colleges to establish Internal Committees, conduct awareness programs, and maintain strict records. The document also defines key terms in the academic context and provides for institutional accountability in preventing and redressing workplace harassment. The regulations came into effect in May 2016 and are legally binding.
